Terms of Service

Please read these Terms of Service ("Terms") carefully before using HeyAddress (heyaddress.com, heyaddress.io, heyaddress.ai) operated by HeyAddress, LLC ("HeyAddress," "we," "us," or "our"). By creating an account, submitting a campaign, or otherwise using the HeyAddress platform, you ("Customer" or "you") signify your unconditional agreement to these Terms. If you do not agree, you are not authorized to use the platform.

HeyAddress is a direct mail remarketing platform that enables businesses to reach website visitors through physical postcards. We act as an intermediary platform; actual print and mail fulfillment is performed by our third-party fulfillment partner(s).

1. Platform Use & Account Responsibilities

Account Creation

To use HeyAddress, you must create an account and provide accurate, complete information including your business name, email address, and billing details. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Authorized Use

HeyAddress is intended for lawful business purposes only. By using the platform, you agree that you will not:

Use the platform for any unlawful purpose or in violation of any applicable federal, state, or local law or regulation
Submit campaign materials that are obscene, defamatory, fraudulent, harassing, or otherwise objectionable
Infringe on any copyright, trademark, patent, or other intellectual property right of any third party
Attempt to gain unauthorized access to any portion of the platform or its supporting systems
Use the platform to send unsolicited bulk communications or to engage in any form of spam
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Submit materials that promote controlled substances, illegal activity, or violence

Tracking Tag

To enable direct mail remarketing, you must install a HeyAddress tracking tag (JavaScript snippet) on your website. You represent and warrant that you have the right and authority to install such tracking technology on your website and that doing so complies with all applicable privacy laws and regulations, including but not limited to applicable state privacy statutes and the CAN-SPAM Act. You are solely responsible for maintaining an appropriate privacy policy on your website disclosing your use of such tracking technology.

2. Campaign Submission & Accuracy

Campaign Information

You are solely responsible for the accuracy and completeness of all campaign details submitted through the HeyAddress platform, including but not limited to your property URL, target geography, postcard size, creative files, budget settings, and suppression lists.

Creative Materials

You are solely responsible for all postcard creative materials you submit, including ensuring that such materials:

Comply with all applicable laws and USPS postal regulations
Do not infringe on any third-party intellectual property rights
Contain no false, misleading, or deceptive content
Meet the technical specifications required by our fulfillment partner (minimum 300 DPI, CMYK color mode, correct bleed and safe zone requirements)

HeyAddress reserves the right, in its sole discretion, to reject any creative materials deemed inappropriate, non-compliant, or otherwise unsuitable for mailing. You will be notified promptly if your materials are rejected and given the opportunity to resubmit.

Design Services

If you elect to purchase HeyAddress design services, a flat fee will be charged as disclosed at time of purchase. Design services are performed by our creative team and the resulting postcard design remains subject to your review and approval before campaign launch. Design fees are non-refundable once design work has commenced.

3. Pricing, Payment & Billing

Rates

HeyAddress charges on a per-card-mailed basis at the retail rates disclosed on our pricing page at the time of campaign setup. Current rates are:

Standard Postcard (4.25" × 6"): $1.45 per card mailed
Jumbo Postcard (6" × 9"): $1.65 per card mailed
Creative Design Services: $750 flat fee (optional)

HeyAddress reserves the right to update pricing with reasonable notice. Rate changes will not apply to campaigns already in active mailing status at the time of the change.

Billing Cycle

Billing is prepaid. When you submit a campaign, HeyAddress charges your Stripe-connected payment method for your selected budget, which establishes a prepaid balance on your account. As postcards are mailed, that balance is drawn down at your applicable per-card retail rate. For ongoing campaigns, when your balance falls below a set threshold, HeyAddress automatically recharges your payment method to replenish it so that mailing continues without interruption. HeyAddress does not mail postcards in excess of your available prepaid balance.

Payment Authorization

By submitting a campaign, you authorize HeyAddress to charge your payment method on file for your initial prepaid balance and for any automatic recharges needed to continue an ongoing campaign, consistent with the budget you set. You agree to maintain a valid payment method in your account at all times during active campaign periods.

Failed Payments

If an automatic recharge or other charge fails, HeyAddress will notify you via email and may pause your active campaigns until a valid payment method is provided and your balance is replenished. Because mailing is funded from your prepaid balance, HeyAddress will not mail postcards beyond the funds already collected.

Refunds & Cancellations

Because postcard fulfillment involves physical production and third-party mailing, HeyAddress does not issue refunds for cards that have already been produced and entered the mail stream. Campaigns may be paused or cancelled at any time. Any unused prepaid balance remaining after you pause or cancel a campaign is refundable to your original payment method upon request. Design fees are non-refundable once work has commenced.

Taxes

Prices listed do not include applicable sales, use, or other taxes. You are responsible for all taxes applicable to your use of the HeyAddress platform, except for taxes on HeyAddress's net income.

4. Campaign Management & Fulfillment

Fulfillment Partner

Physical postcard production and mailing is performed by HeyAddress's third-party fulfillment partner. HeyAddress coordinates fulfillment on your behalf but is not the printer or mailer of record. Production and mailing timelines are estimates and are not guaranteed.

Budget Changes & Pauses

Requests to change monthly budgets, pause campaigns, or modify mailing parameters are subject to our fulfillment partner's daily processing cutoff (3:00 PM Pacific Time on business days). Changes submitted after this cutoff will take effect the following business day. HeyAddress will make commercially reasonable efforts to implement your requested changes promptly but cannot guarantee same-day changes.

Mail Delivery

HeyAddress's fulfillment obligations are limited to delivering your campaign to the U.S. Postal Service. HeyAddress and its fulfillment partners are not responsible for USPS delivery delays, lost mail pieces, or other USPS performance failures. In no event will HeyAddress be liable for special, incidental, or consequential damages arising from mailing delays or delivery failures.

Address Matching

HeyAddress uses third-party identity resolution technology to match website visitors to mailing addresses. Address match rates are estimates and not guaranteed. HeyAddress does not warrant a specific match rate or that any particular website visitor will be matched to a mailable address. Undeliverable mail pieces are the responsibility of the USPS and are not subject to refund.

5. Mailing Lists & Suppression

Customer-Supplied Lists

If you provide suppression lists or other customer-supplied mailing data, you represent and warrant that you have the right to use such data for direct mail purposes. HeyAddress will maintain the confidentiality of your suppression lists and use them solely in connection with your campaigns. Your mailing list data is your exclusive property and will not be sold or shared with third parties.

Data Accuracy

HeyAddress will process suppression lists and address data using commercially reasonable standards. However, 100% accuracy in duplicate removal, address correction, or National Change of Address (NCOA) processing cannot be guaranteed due to data variances. HeyAddress is not responsible for undeliverable pieces resulting from inaccurate data in customer-supplied lists.

6. Privacy & Data

Privacy Policy

Your use of the HeyAddress platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you confirm that you have read and agree to our Privacy Policy.

Customer Data

HeyAddress will process personal data submitted by you or collected via your tracking tag solely for the purpose of fulfilling your campaigns and operating the platform. We implement commercially reasonable technical and organizational security measures to protect your data. HeyAddress uses HTTPS, data encryption, and data retention policies to safeguard information on our secure network.

Your Privacy Obligations

You are independently responsible for complying with all applicable privacy laws in connection with your use of direct mail remarketing, including providing appropriate disclosures to your website visitors regarding the collection of their data for remarketing purposes.

7. Intellectual Property

Your Materials

All creative materials, logos, images, and other content you submit to HeyAddress remain your sole property. You grant HeyAddress a limited, non-exclusive license to use your materials solely for the purpose of fulfilling your campaign. This license terminates upon completion or cancellation of your campaign.

HeyAddress Platform

The HeyAddress platform, including its software, design, trademarks, and all content created by HeyAddress, is the exclusive property of HeyAddress, LLC and is protected by applicable intellectual property laws. You may not reproduce, duplicate, resell, or otherwise exploit any portion of the platform without our express written consent.

Promotional Use

HeyAddress reserves the right to use anonymized campaign performance data and aggregated statistics for marketing and product improvement purposes. HeyAddress will not use your brand name, logo, or specific campaign materials in any external promotional materials without your prior written consent.

8. Indemnification

You agree to indemnify, defend, and hold harmless HeyAddress, LLC and its officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the HeyAddress platform
Any campaign materials you submit, including any claim that such materials infringe the intellectual property or other rights of any third party
Your violation of these Terms or any applicable law or regulation
Your installation or use of the HeyAddress tracking tag on your website
Any claim by a recipient of your direct mail pieces

9. Disclaimers & Limitation of Liability

As-Is Service

The HeyAddress platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. HeyAddress does not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, HeyAddress's total liability to you for any claim arising out of or related to these Terms or your use of the platform shall not exceed the total fees paid by you to HeyAddress in the three (3) months immediately preceding the event giving rise to the claim. In no event will HeyAddress be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill, even if HeyAddress has been advised of the possibility of such damages.

10. Term & Termination

These Terms remain in effect for as long as you maintain an account with HeyAddress. Either party may terminate the relationship at any time. Upon termination:

You remain responsible for all charges incurred prior to the termination date, including for any cards already entered into the mail stream
HeyAddress will retain your data for a reasonable period as required by law or our data retention policy, after which it will be deleted
Sections 6 (Privacy & Data), 7 (Intellectual Property), 8 (Indemnification), 9 (Disclaimers & Limitation of Liability), and 11 (Governing Law) survive termination

HeyAddress reserves the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any other conduct that HeyAddress determines, in its sole discretion, to be harmful to the platform, our fulfillment partners, or other users.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the HeyAddress platform shall be resolved by binding arbitration in New York County, New York, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Any claim arising under these Terms must be filed within one (1) year of the date of the alleged breach or such claim shall be permanently barred.

12. Changes to These Terms

HeyAddress reserves the right to update or modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after the effective date of updated Terms constitutes your acceptance of the revised Terms. We will log the date of each update at the top of this document.
